Queensborough Doctor Sentenced For Selling Drugs
A Queensborough doctor appeared in federal court and submitted a guilty plea for illegally distributing drugs and now he has received sentencing
According to Justice.gov, Last September Acting United States Attorney Antoinette T. Bacon and Special Agent in Charge, Ray Donovan of the U.S. Drug Enforcement Administration, announced that 52-year old former doctor Scott McMahon had pleaded guilty to Identity Theft and Unlawful Drug Distribution.
The Queensborough resident admitted that he had distributed controlled substances outside of professional practice and for no legitimate medical purpose. McMahon also admitted that he had misused personal information in the course of fraudulently obtaining control substances from pharmacies.
McMahon admitted that from December 2018 through August 2019 he fraudulently wrote prescriptions for specific patients with the scheme of receiving kickbacks from the drugs. He wrote prescriptions for methylphenidate which is a generic form of Ritalin and it is a Schedule II controlled substance. McMahon used the personal information of his patients' children to write the prescriptions. The patients would then pick up the prescriptions using the child’s names and split the medications with him.
Court records also show that McMahon admitted that he prescribed ketamine intranasal spray to an individual for no legitimate medical reason.
As part of his guilty plea McMahon agreed to pay $46,225.24 for civil penalty claims. He also agreed to forfeit $6774.76 that was seized by the government as part of the criminal case. He had to forfeit his New York State medical license and his DEA registration.
Scott McMahon has been in custody since September 10, 2020. He was sentenced by Senior United States District Judge Thomas J McAvoy to 38 months in prison. He was also ordered to serve a three-year term of supervised probation once he is released.
