Beyonce’s Motion to Dismiss ‘Formation’ Lawsuit Denied

A lawsuit involving Beyoncé and her hit song “Formation” will be moving forward as a Louisiana federal judge denied the singer’s motion to dismiss a copyright claim, Billboard reports.

Originally filed in February by the estate of the late Messy Mya, the lawsuit claims portions from the late artis’s videos “A 27 Piece Huh?” and “Booking The Hoes From New Wildin” were sampled in “Formation.”

According to the estate, the phrases “What happened at the New Wildin?,” “B—-, I’m back by popular demand” and “Oh yeah, baby — I like that,” were used without permission in “Formation.” Beyoncé’s team tried to use the fair use defense, but the judge decided the samples were a “qualitatively significant” use.” The singer’s team has yet to comment on the latest update.
